The jury in the murder trial of Brandon McInerney can not reach a verdict. They have at it for the past 8 weeks, but it seems that no decision can be made.

At this time, we are not sure if this will be a mistrial or not.

Marcellus Andrews' Family believe his death was not a Hate Crime, because he's not Gay

In a community meeting at the Jubilee United Methodist Church in Waterloo, IA, many gathered to discuss Marcellus Andrews' death. But his family believe he was not gay and his death is not a hate crime.

Waterloo police acknowledge the remarks but said the assault was not a a hate crime, but rather was motivated by a dispute between two rival groups.

Andrews' family does not believe he was gay.

His sister, Nichella Andrews, 22, supports the police in ruling out a hate crime. Witnesses' accounts of what allegedly happened have been blown out of proportion, she said. A cousin, Renicia Haywood, 18, noted that a person who displays perceived feminine actions is not necessarily gay.

"They didn't come to beat him up because he was gay," Haywood said. "There's more to the story."

"Gay or not, perceived as gay still ends up being a hate crime under those conditions," said Jim Day, vice president of the Black Hawk County branch of the National Association for the Advancement of Colored People. "Perception of gay and being gay still both qualify."

In my opinion, I believe Marcellus was gay. But I can see why his family may not be ready to accept that. However, I have to disagree with them. This was a hate crime, no doubt about it.

Judge Halts Dan Choi's Trial

Dan Choi is on trial this week for his 'protest' from last November. However, the judge halted the trial for 10 days to investigate if the federal government is guilty of malicious prosecution. 

On Wednesday, the judge presiding over the current case said he believes Choi has shown, at least preliminarily, that he is being treated differently because of the subject of his protests: "don't ask, don't tell." President Barack Obama put an end to the policy in July. As of Sept. 20, gay service members will be able to acknowledge their sexual orientation openly.


Magistrate Judge John M. Facciola said the testimony presented at trial suggested that "the nature of his speech or what he said," meant Choi was prosecuted differently, according to a transcript of the proceedings.


As a result of Facciola's statements, an attorney for the government, Angela George, said she planned to have the judge's actions reviewed by higher authorities, and Facciola put the trial on hold for 10 days. In papers filed with the court, George says Choi was treated no differently than other similar protesters.


One of Choi's attorneys, Robert Feldman, said he believed that the judge's comments Wednesday mean his client has "effectively won the case" and that the charges against him will ultimately be dismissed.

We will see how this goes, but I hope this doesn't turn into "Obama wanted Dan to suffer" type of drama.

HRC: Who Will Lead Them?

As most of you know, the HRC will be looking for a new president of their organization. They have until March of 2012 to do this, so you know the search will be interesting.

But as the search begins, I wanted to give my 45 cents on what I think they will and won't look for.

• WILL: Someone who can raise money. The HRC is known for their fundraisers. This person will need to know where and who to use to keep the money flowing.
• WON'T: Someone with a personal agenda. This person will have to remember that it's not about them. They have a job to do for the public.
• WILL: Someone who's political savvy. This person will have to be on the good side of politicians. They don't have to kiss their asses, but they will need to know how the work it in the White House and other places.
• WON'T: Someone who's a 'Johnny One Note'. They can't be fixated on one particular issue, they have to look a the bigger picture and weight out what's doable and what's needing back-up.
• WILL: Someone who's realistic. My biggest problem with progressives is their lack of big picture vision. This president has to be realistic and transparent with the decision making process.
• WON'T: Someone who's not ready for prime time. As I said in other posts, you can't expect grassroot philosophies to work in a political setting. They can shape deals and measures, but it has to be made to hit multiple pieces of the issue.
• WILL: Someone who's likeable.
• WON'T: Someone who's just too much.
• WILL: Someone with a strong organizing background and solid leadership skills.
• WON'T: Someone without those skills.
• WILL: Someone who can see the big picture.
• WILL: Someone who can make the tough decisions.
• WON'T: Someone who takes things personally.
• WON'T: A deeply rooted Progressive.
• WILL: Someone like Keith Boykin.
