Passed in 2013, the law said clinics providing abortion services must meet the same building standards as ambulatory surgical centers. And it required doctors performing abortions to have admitting privileges at nearby hospitals.

Since the law was passed, the number of clinics providing abortion services in Texas dropped to 19 from 42. Opponents said that number would fall to ten if the Supreme Court upheld the law.

The Center for Reproductive Rights called the law "an absolute sham," arguing that abortion patients rarely require hospitalization and that many patients simply take two pills.

Justice Stephen G. Breyer in writing the majority opinion said "neither of these provisions offers medical benefits sufficient to justify the burdens upon access that each imposes. Each places a substantial obstacle in the path of women seeking a pre-viability abortion, each constitutes an undue burden on abortion access, and each violates the Federal Constitution."

Breyer was joined in the majority by Justices Ruth Bader Ginsburg, Elena Kagan and Anthony M. Kennedy. Chief Justice John G. Roberts Jr., Samuel A. Alito Jr. and Clarence Thomas dissented.

Supreme Court sides with Hobby Lobby

The Supreme Court ruled 5-4 in Burwell v. Hobby Lobby case today.

A quick flashback before we start:
The Hobby Lobby corporation have strong religious objections to certain types of contraceptive devices and are suing to protect those religious rights against the ACA (Affordable Care Act). Basically, Hobby Lobby wants opt out of providing contraception coverage under Obamacare.

While the ruling was narrow, I think other companies could follow suit.

The ruling deals directly with only a small provision of Obamacare and will not take down the entire law but it amounts to a huge black eye for Obamacare and its backers. The justices have given Obamacare opponents their most significant political victory against the health care law, reinforcing their argument that the law and President Barack Obama are encroaching on Americans’ freedoms.

“Under the standard that [the Religious Freedom Restoration Act] prescribes, the HHS contraceptive mandate is unlawful,” Justice Samuel Alito wrote in the opinion, which was joined by Chief Justice John Roberts and Justices Antonin Scalia, Clarence Thomas and Anthony Kennedy.

The court’s four liberal justices called it a decision of “startling breadth” and said that it allows companies to “opt out of any law (saving only tax laws) they judge incompatible with their sincerely held religious beliefs.”

The court appeared to reject, 7-2, the Obama Administration’s argument that for-profit companies cannot assert religious rights under RFRA. Only Justice Sonia Sotomayor joined the portion of Ruth Bader Ginsburg’s dissent that argues companies do not have such rights. Justices Stephen Breyer and Elena Kagan did not join that section and did not explicitly state their views on the point.
The decision could open the door to other closely held corporations seeking to withhold coverage for other medical procedures at odds with firm religious beliefs. It marks the first time that the Supreme Court has allowed companies the ability to declare a religious belief – a decision that could reverberate far past the Affordable Care Act to other laws and issues.

GOP Platform calls for a Constitutional Ban on Abortion

The GOP Platform draft language is causing more drama. This time, they are supporting a constitutional ban on abortion without specifying exclusions in the cases of rape or incest.

It says:

"Faithful to the 'self-evident' truths enshrined in the Declaration of Independence, we assert the sanctity of human life and affirm that the unborn child has a fundamental individual right to life which cannot be infringed. We support a human life amendment to the Constitution and endorse legislation to make clear that the Fourteenth Amendment's protections apply to unborn children."

Really? After the Akin mess... Really? Somebody needs to get this group together.

In Tennessee: Abortion Bill could make Abortion Providers' Names Public

Y'all, I swear Tennessee is just becoming a hot ass mess! From the Don't Say Gay bill to over religious rules, they have just gone crazy.

Now, this crap! This Abortion bill they are trying pass, will but the doctors and women on blast!

The Life Defense Act of 2012, sponsored by state Rep. Matthew Hill (R-Jonesboro), mandates that the Tennessee Department of Health make detailed demographic information about every woman who has an abortion available to the public, including her age, race, county, marital status, education level, number of children, the location of the procedure and how many times she has been pregnant. Each report would also have to include the name of the doctor who performed the procedure.

Several health organizations, including the Tennessee Medical Association and Planned Parenthood, are concerned that the bill will make doctors and women vulnerable to attacks, especially considering the murder of Dr. George Tiller, a Kansas abortion provider, by an anti-abortion activist in 2009.

"We live in an environment where there is a lot of violence against abortion providers, clinics, and clinic staff," said Jeff Teague, president and CEO of Planned Parenthood of Middle and Eastern Tennessee. "We've had physicians who provide abortion care murdered in the past few years. This is an attempt to intimidate physicians who provide abortion care and the women who seek abortions and to terrorize them."

Rep. Gary Odom (D-Nashville) called the bill "very dangerous," and said the Republicans who voted it out of a House subcommittee offered "no explanation as to why this was something that needed to be done."

These folks are putting the doctor and client in possible danger. In trying to teach a moral lesson, these Repubs are causing problems. People in my home state, fight this mess!

Texas Approves Controversial Abortion Bill

You know Texas can't sit still for too long. It seems the state has to do something crazy to draw attention. Well, yesterday they exceeded expectations. Their lawmakers have passed a bill that makes doctors to perform a sonogram before giving the patient an abortion.

The legislation requires doctors to conduct a sonogram at least 24 hours before an abortion and to provide the woman with the opportunity to see the results and hear the fetal heartbeat. The doctor is also required to describe what the sonogram shows.


In cases of incest, rape or fetal abnormality, the woman doesn't have to hear a description of the fetus.


Texas Governor Rick Perry, a Republican, stands behind the controversial measure. While different versions of the proposal were under debate earlier this year, Perry regarded the legislation as an emergency priority.


"Ensuring Texans have access to all the information when making such an important decision is a critical step in our efforts to protect life, and I look forward to this legislation reaching my desk very soon," said Perry in a statement earlier this week, lauding the state legislature for advancing the measure. 

I hope women are outraged by this silly bill. It's just wrong and invasive.

Randy Neugebauer Screamed "Baby Killer" to Stupak!

Well, the person who called Stupak a "Baby Killer" is Randy Neugebauer.

Yes, it was Randy Neugebauer and "surprise" he's from TEXAS!

"Last night was the climax of weeks and months of debate on a health care bill that my constituents fear and do not support. In the heat and emotion of the debate, I exclaimed the phrase 'it's a baby killer' in reference to the agreement reached by the Democratic leadership. While I remain heartbroken over the passage of this bill and the tragic consequences it will have for the unborn, I deeply regret that my actions were mistakenly interpreted as a direct reference to Congressman Stupak himself.

"I have apologized to Mr. Stupak and also apologize to my colleagues for the manner in which I expressed my disappointment about the bill. The House Chamber is a place of decorum and respect. The timing and tone of my comment last night was inappropriate."

Yes, it was inappropriate.

Abortion Doctor Kiled at Church

This is odd. According to anonymous police sources, George Tiller, a doctor known for performing late-term abortions, was shot and killed at his church.

Media reports say that abortion provider Dr. George Tiller has been shot and killed at his Wichita church.

Tiller has been a favored target of anti-abortion protesters, and he testified that he and his family have suffered years of harassment and threats. His clinic was the site of the 1991 "Summer of Mercy" protests marked by mass demonstrations and arrests. His clinic was bombed in 1985, and an abortion opponent shot him in both arms in 1993.

His family never thought this would happen.

The killer is still loose.

Don't Hate, Notre Dame...Appreciate

At Notre Dame, some folks were upset that Obama spoke at their graduation.

Somewhere down the road, they confused his pro-choice stance with "kill the unborn babies". But if they stopped and processed the reality, they would see that Obama supports the choice, the choice a woman makes about her life.

I've always believed abortion was the woman's choice to make. However, everyone has their beliefs regardless of how sane or crazy it is. Maybe after hearing Obama's speech, some folks will be open to what he's saying.

"Maybe we won't agree on abortion, but we can still agree that this is a heart-wrenching decision for any woman to make, with both moral and spiritual dimensions.
