Elena Kagan is finally Confirmed


Elena is now, for real! She will serve on the high court.
Chalk up another legacy for President Obama, as the Senate confirms Supreme Court nominee Elena Kagan.

Kagan, who will be the fourth woman to serve on the high court after she is sworn in, won the job on a Senate vote of 63-37.

Currently the U.S. Solicitor General, Kagan has "earned her place at the top of the legal profession," said Senate Judiciary Chairman Patrick Leahy, D-Vt.

Kagan's background as a Supreme Court law clerk, as well as stints in the Senate and in the Clinton and Obama administrations, also gives her "experience in all three branches of our government," Leahy said. "This is unique."

Kagan watched the vote from her office at the Justice Department.

Only five Republicans voted in favor of Kagan's nomination. Last year, just nine Republicans voted for Justice Sonia Sotomayor, Obama's first Supreme Court appointee.

President Obama taps Elena Kagan for high court!
President Barack Obama will nominate U.S. Solicitor General Elena Kagan to serve as an associate justice on the U.S. Supreme Court, NBC News’ Pete Williams reported late Sunday night.

Kagan, 50, served as the Dean of Harvard Law School from 2003 to 2009. Obama nominated her to serve in her current post as solicitor general early in 2009, and she won Senate confirmation by a vote of 61-31. She is the first woman to serve as solicitor general of the United States.

Now the fireworks will really start!

Is Elena Kagan the One?



Interesting rumor. In Politico, Mike Allen says that Elena Kagan may be named the new Judge.
"Look for President Obama to name his Supreme Court pick Monday, and look for it to be Solicitor General Elena Kagan, a former Harvard Law dean. The pick isn't official, but top White House aides will be shocked if it's otherwise. Kagan's relative youth (50) is a huge asset for the lifetime post. And President Obama considers her to be a persuasive, fearless advocate who would serve as an intellectual counterweight to Chief Justice Roberts and Justice Scalia, and could lure swing Justice Kennedy into some coalitions The West Wing may leak the pick to AP's Ben Feller on the later side Sunday, then confirm it for others for morning editions."
Now, this is his view, this is not official. But I wonder if this is true, will it be an easy process or drawn out because of silly Repubs? I guess we will learn more on Monday.

It's Official... Supreme Court Justice John Paul Stevens is Retiring


Yes, we heard the rumors, but it's true.

Supreme Court Justice John Paul Stevens is retiring from his position in the summer.

Stevens' announcement had been hinted at for months. It comes 11 days before his 90th birthday.

Throughout his tenure, which began after President Gerald Ford nominated him in 1975, Stevens usually sided with the court's liberal bloc in the most contentious cases – those involving abortion, criminal law, civil rights and church-state relations. He led the dissenters as well in the case of Bush v. Gore that sealed President George W. Bush's election in 2000.

Stevens began signaling a possible retirement last summer when he hired just one of his usual complement of four law clerks for the next court term. He acknowledged in several interviews that he was contemplating stepping down and would certainly do so during Obama's presidency.

Sonia Sotomayor is Obama's pick for Supreme Court


Interesting news

President Barack Obama tapped federal appeals judge Sonia Sotomayor for the Supreme Court on Tuesday, officials said, making her the first Hispanic in history picked to wear the robes of a justice.

If confirmed by the Senate, Sotomayor, 54, would succeed retiring Justice David Souter. Two officials described Obama's decision on condition of anonymity because no formal announcement had been made. Administration officials say Sotomayor would bring more judicial experience to the Supreme Court than any justice confirmed in the past 70 years.

A formal announcement was expected at midmorning.

Obama had said publicly he wanted a justice who combined intellect and empathy — the ability to understand the troubles of everyday Americans.

Democrats hold a large majority in the Senate, and barring the unexpected, Sotomayor's confirmation should be assured. If approved, she would join Justice Ruth Bader Ginsburg as the second woman on the current court.
