In Kentucky: The Gay Marriage Ban is at Question due to a Murder Case

In this interesting situation, the issue of gay marriage could affect the outcome of a murder case. Geneva Case doesn't want to testify against her partner, Bobbie Jo Clary, of murder. Bobbie Jo is accused of the death of George Murphy in 2011.

What's up for debate is their spousal rights. Does Geneva have the right to use her spousal privilege that would shield her from testifying against Bobbie Jo? And will it be recognized in a state that is politically conservative?

This is an interesting side line in the case. The judge is now in a unique position of knocking down a discriminatory amendment.
