Mozilla/Firefox CEO called out for Prop 8 Donation

So, the new CEO of Mozilla, Brendan Eich, is in the hot seat.

Back in 2008, this man donated $1000 to support Prop 8. Now as folks hold him accountable, Brandon went to his site and expressed his point of view:

A donation that I made in support of California Proposition 8 four years ago became public knowledge and sparked a firestorm of comments in the last few days, mostly on Twitter.

People in other countries or other U.S. states do not know why “Mozilla” was listed in the donation data. Donors above a certain amount are required by the State of California to disclose their employer. Mozilla had nothing to do with the donation.

I’m not going to discuss Prop 8 here or on Twitter. There is no point in talking with the people who are baiting, ranting, and hurling four-letter abuse. Personal hatred conveyed through curse words is neither rational nor charitable, and strong feelings on any side of an issue do not justify it.

In contrast, people expressing non-abusive anger, sadness, or disagreement, I understand, grieve, and humbly accept.

In my view, the worse of the two decisions is the Proposition 8 case. For six long years, NOM and our allies have fought with everything we had to preserve what God Himself created — marriage, the foundation of society itself. NOM was the largest contributor to putting Proposition 8 on the ballot. I personally uprooted my family and lived for several months in California to help campaign for its successful passage. And we've contributed several hundred thousand dollars to help preserve it through many legal challenges. 

I've got a message for the Supreme Court: We're not going to take their wrong decisions sitting down. The decision refusing to hear the Proposition 8 appeal has rewarded the utter dereliction of duty by California's Governor and Attorney General, whose legal obligation was to defend initiatives adopted by the people. That leaves in place the erroneous decision of a single San Francisco federal court judge, who made an illegitimate attempt to legislate from the bench.

Yesterday, I got to speak to a huge group of people during the Decision Day event in Los Angeles/WeHo. It was truly an inspiring moment.

Seeing the faces and listening the stories about marriage, love and hope was what I needed to hear. I felt very honored to be a part of history yesterday. Who would have thought we would be talking about the end od DOMA and Prop 8.

Hell, who would've thought I would be on stage, speaking about Black voices and the continuing fight for equality.

Who knew.

Recap and Analysis of the Prop 8 Oral Argument

From the SCOTUS Blog here is the analysis of what went down:

Much will be written about the Proposition 8 oral argument. The bottom line, in my opinion, is that the Court probably will not have the five votes necessary to get to any result at all, and almost certainly will not have five votes to decide the merits of whether Proposition 8 is constitutional. 

Several Justices seriously doubt whether the petitioners defending Proposition 8 have “standing” to appeal the district court ruling invalidating the measure. These likely include not only more liberal members but also the Chief Justice. If standing is lacking, the Court would vacate the Ninth Circuit’s decision. 

The Justices seem divided on the constitutionality of Proposition 8 on ideological lines, four to four – i.e., all the members other than Justice Kennedy. For the more liberal members of the Court, there was no clarity on how broadly they would rule.
But Justice Kennedy seemed very unlikely to provide either side with the fifth vote needed to prevail. He was deeply concerned with the wisdom of acting now when in his view the social science of the effects of same-sex marriage is uncertain because it is so new. He also noted the doubts about the petitioners’ standing. So his suggestion was that the case should be dismissed. 

If those features of the oral argument hold up – and I think they will – then the Court’s ruling will take one of two forms. First, a majority (the Chief Justice plus the liberal members of the Court) could decide that the petitioners lack standing. That would vacate the Ninth Circuit’s decision but leave in place the district court decision invalidating Proposition 8. Another case with different petitioners (perhaps a government official who did not want to administer a same-sex marriage) could come to the Supreme Court within two to three years, if the Justices were willing to hear it.
Second, the Court may dismiss the case because of an inability to reach a majority. Justice Kennedy takes that view, and Justice Sotomayor indicated that she might join him. Others on the left may agree. That ruling would leave in place the Ninth Circuit’s decision.

So for now Prop 8 is invalid. More to come

Football Players Chris Kluwe and Brendon Ayanbadejo file a Brief in Support of Marriage Equality

Lord, everybody and their mama is filing briefs!

Football Hotties Chris Kluwe and Brendon Ayanbadejo filed their joint brief yesterday (something about that phrase sounds nasty).

Their intro states:

Sports figures receive a celebrity status that influences a large majority of the American population. For far too long, professional sports have been a bastion of bigotry, intolerance, and small-minded prejudice toward sexual orientation, just as they had been to racial differences decades earlier. That is finally changing, and changing drastically.

The NFL, NHL, MLB, and NBA, at the league level, team level, and individual level, are finally speaking out against homophobia and intolerance of LBGTQ individuals. More and more of us realize that using demeaning slur words like “faggot,” “queer,” and “gay” can have serious, negative consequences. Not necessarily consequences for us. Instead, consequences for the children and adults who look up to us as role models and leaders. Consequences for children and adults who mimic our behavior when they interact with others. And consequences that can be severe, long-lasting, and not infrequently lead to suicide and other serious harm.

The Obama Administration will file a Friend-of-the-Court brief in support for Marriage Equality

This is some huge stuff, so check it out

Administration officials say the Justice Department will urge the U.S. Supreme Court to allow same-sex marriage to resume in California, wading into the protracted legal battle over Proposition 8 and giving gay-rights advocates a new court ally. 

After first suggesting it would not get involved, the Obama administration will file a friend-of-the-court brief late today in support of the two gay couples who launched the fight over the issue four years ago, the officials said. Today is the last day for filing briefs in support of the couples' position.

Big Corporations file a Supreme Court brief supporting Marriage Equality

More big news in the gay marriage front.

Several corporations support the take down of Prop 8. In fact, 60 plus companies will file a brief against the anti-gay law.

According to a draft copy obtained by Fortune, the companies argue that such laws "send an unmistakeable signal that same-sex couples are in some way inferior to opposite-sex couples, a proposition that is anathema to amici's commitment to equality and fair treatment to all."

At least 60 companies had committed to signing the brief as of Tuesday evening, according to Joshua Rosenkranz, who is counsel of record on the brief and head of the Supreme Court and appellate litigation practice at Orrick, Herrington & Sutcliffe. That number is expected to rise by Thursday, however, according to Rosenkranz. Others who have already committed to sign include AIG, Becton Dickinson, Cisco, Cummins, Kimpton, Levi Strauss, McGraw Hill, NCR, Nike, Office Depot, Oracle, Panasonic, Qualcomm, and Xerox.

Apple, Facbook and ebay are also on board.
