For a period I thought Boies was going to blow it. I thought Olsen was going to have to jump up and rescue him. But Boies pulled it out in the end.
My predictions: the panel will rule 3-0 that Imperial county has no standing to intervene; will rule 2-1 that the proponents have no standing to appeal; and if standing is found, will rule 2-1 to uphold the lower court under rational basis. The panel is not going to touch heightened scrutiny with a ten foot pole. Bottom line: we win.
