Armed Militia take over Federal Building in Oregon to protect Criminals

So, when you owe money to government and you don't to pay... What do you do? Call up a militia a.k.a. American Terrorists for help.

This group of losers are in Burns, Oregon to defend ranchers Dwight Hammond Jr. and his son Steven. They don't want to pay the government for using their resources so they tried to fight the system (ARSON), which got them in serious trouble. They are scheduled to report to prison on Monday. Well, these so-called patriots heard about this and decided to have a stand-off. Oh, this group is led by the Bundy family, the same folks involved in the last militia mess.

Here's more:
The Bundy family of Nevada joined with hard-core militiamen Saturday to take over the headquarters of the Malheur National Wildlife Refuge, vowing to occupy the remote federal outpost 50 miles southeast of Burns for years.

The occupation came shortly after an estimated 300 marchers — militia and local citizens both — paraded through Burns to protest the prosecution of two Harney County ranchers, Dwight Hammond Jr. and Steven Hammond, who are to report to prison on Monday.

Among the occupiers is Ammon Bundy, son of Nevada rancher Cliven Bundy, and two of his brothers. Militia members at the refuge claimed they had as many as 100 supporters with them. The refuge, federal property managed by the U.S. Fish and Wildlife Service, was closed and unoccupied for the holiday weekend.

In phone interviews from inside the occupied building Saturday night, Ammon Bundy and his brother, Ryan Bundy, said they are not looking to hurt anyone. But they would not rule out violence if police tried to remove them, they said.

"The facility has been the tool to do all the tyranny that has been placed upon the Hammonds," Ammon Bundy said.

"We're planning on staying here for years, absolutely," he added. "This is not a decision we've made at the last minute."

Brian Brown whines over the 9th Circuit Court Smackdown

Of course, Brian was going to cry about NOM's big loss. But he shouldn't be shocked about it, they have been on this losing streak for awhile.

Brian said on his blog
"We are of course disappointed with the Ninth Circuit's decision today. The Ninth Circuit did not reach the appeal of the denial of motion to intervene, holding instead that even if NOM had been allowed to intervene on behalf of its members (including Oregon voters, wedding services providers, and a county clerk), it had no standing to appeal the judgment below even though the elected officials of the state refused to provide any defense of the marriage amendment adopted by a strong majority of Oregonians.

"We believe that the decision conflicts with a prior Ninth Circuit opinion specifically recognizing that a County Clerk with the duty to issue marriage licenses likely would have standing to intervene and appeal an adverse judgment. NOM alleged under oath that it had among its members just such a county clerk, and it sought to intervene on the clerk's behalf under the Supreme Court's well-established precedent in the case of NAACP v. Alabama allowing membership organizations to pursue the interests of their members when there are substantial hurdles to the members litigating in their own name, such as the real threats of harassment and violence that have been manifested elsewhere in the country around the marriage issue. Because of that conflict, we will certainly be exploring whether to file a petition for rehearing en banc with the full Ninth Circuit or whether we will seek review in the Supreme Court itself.

"Ultimately, though, NOM remains concerned that a sovereign act of the people of Oregon went entirely undefended by the elected officials of Oregon, an abdication of duty that resulted in the long-standing understanding of marriage in Oregon being rewritten by a single federal court judge. The policy fight over the definition of marriage is something that should ultimately be resolved by the people, not unelected judges. For now, Oregonians have been denied their voice on that important policy issue, and that is truly regrettable."

Federal Appeals Court Smacks Down NOM's attempt to halt Oregon's Marriage Equality

Oh NOM...

The 9th U.S. Circuit Court of Appeals has denied NOM's request to halt marriage equality in Oregon to intervene.

The court basically slammed the door in NOM's face. Now, it's up to them if they want to take the case to the Supreme Court.

Will NOM appeal? Who knows, but it's clear, this is just one out of many defeats in their foolishness.

If they don't appeal to the Supreme Court, all threats against marriage equality is done.

NOM chairman John Eastman whines over Oregon

The losing streak continues for NOM.

After the Supreme Court denied their request for a stay on Oregon's marriage equality, they took to their blog to whine and cry.

See here
"We are disappointed that the US Supreme Court has declined to issue a stay of a federal judge's order redefining marriage in Oregon. Because the state Attorney General has worked in concert with the plaintiffs to deny the people of Oregon a defense of their state marriage amendment, and because the trial judge refused our request to defend the amendment, the people have at least temporarily lost their common-sense law which defines marriage as the union of one man and one woman. It's important to recognize that the Supreme Court has not decided the merits of the underlying issue. NOM has filed an appeal of the trial judge's decision to prevent us from intervening in the case to defend Oregon's marriage amendment. That appeal is on track, with briefs due in the Ninth Circuit Court of Appeal in August and September, and oral argument sometime afterwards. We will continue to press this case because we believe that the people of Oregon are entitled to a vigorous defense of marriage, and because it is in the public interest to preserve marriage as the union of one man and one woman."

Justice Anthony Kennedy is weighing in on the Oregon Marriage Battle

Is this dumb luck for NOM?

I told y'all about their last attempt to stop marriage in Oregon, hoping U.S. Supreme Court Justice Anthony Kennedy to issue a stay on the decision.

Well, now he wants more information before ruling on NOM's request.

Here's more
Kennedy asked for briefs to be filed by 1 p.m. Monday from the parties in the two lawsuits that led to U.S. District Judge Michael McShane's May 19 ruling that allowed gays and lesbians to marry in Oregon.

Kennedy, who hears emergency appeals from the region that includes Oregon, could issue a ruling on NOM's motion on its own or pass the issue on to the full court.

At a minimum, Kennedy's action means that he wants more information on the case before he makes a decision. But it's hard to know whether NOM has a strong shot for its argument that the Supreme Court should get involved in the Oregon case because of its unusual nature.
Let's just hope he leaves things alone.

NOM begs U.S. Supreme Court to Stay Oregon Marriage Equality Ruling

NOM... Lord.

This group must love rejection... Anywho they filed a motion with Supreme Court Justice Anthony Kennedy in hopes that he will stay the imposition of marriage equality in Oregon.

They STILL want to intervene in the case.

In their blog, NOM's ChairFool, John Eastman wrote:
“We are asking Justice Kennedy and the U.S. Supreme Court to take the step of staying the decision of Judge McShane so that NOM can pursue its request to intervene in the case in order to mount a defense of the people’s vote for marriage,” said John Eastman, NOM’s chairman and Director of the Center for Constitutional Jurisprudence at The Claremont Institute. “This case is an ugly spectacle of the state refusing to defend the sovereign act of its voters to define marriage as the union of one man and one woman and instead working jointly with the plaintiffs to redefine marriage.”

Oregon joins numerous other states in recent weeks where federal judges have overturned state laws defining marriage as the union of one man and one woman, and instead imposed same-sex marriage. In each of these cases, the court decision has been stayed by the trial judge or an appellate court. The U.S. Supreme Court itself ruled unanimously to stay a decision in Utah that invalidated their state marriage amendment.

“The Supreme Court has made it abundantly clear that it does not want a profound social change such as redefining marriage to be made by trial judges without the Supreme Court itself deciding the issue,” Eastman said. “In Oregon, not only do we have a single trial court judge imposing his own opinion and invalidating the votes of the overwhelming majority of Oregon voters, but the case involves the state Attorney General refusing to even mount a defense of the people’s decision. This should be very troubling to Justice Kennedy."
That's the spirit NOM, keep that losing streak going.

NOM files a request to Stay and an Appeal in Oregon and POOF, it's Denied!

NOM just continues to be messy.

They still believe they can stop gay marriage. Today they filed a Stay Appeal and a Stay Demand with Ninth Circuit Court in Oregon. Their winning streak in intervening has been on a big losing streak. I guess they believe they are doing the work of Freedom and Moral rights.

While they're meddling in Oregon's business, they may have to pay $50,000 for failing to register and disclose its activities in Maine’s 2009 gay marriage referendum.

Perhaps they need to save their money? I think so.

Federal judge denies NOM’s motion to Intervene in the Oregon's Same-Sex Marriage Case

Oh snap! In Oregon, Judge Michael McShane denied NOM's meddling ass from intervening in the oral arguments in federal lawsuit challenging the state's gay marriage ban.

NOM taunted they would jump into this case, claiming they're fighting for the rights of Americans or some crap! Well, the judge wasn't hearing that. Now, the oral arguments will go as scheduled today without NOM's foolishness.

But the judge could consider NOM’s motion to intervene in the next case scheduled on May 14th. If their motion is accepted, the judge will schedule a second briefing on summary judgement or move the case to trial.

Again, NOM, are you tired of losing?

NOM files a motion to Intervene in Oregon's Same-Sex Marriage Case

Back in Feburary, Oregon's Attorney General Ellen Rosenblum decided not to defend the gay marriage ban during a court challenge from same-sex couples.

As the case moves forward to end the ban, NOM brings their broke asses in to start trouble. These bastards want to intervene the Oregon case.

This is what they wrote in their blog:
The National Organization for Marriage (NOM) said it will file a motion in federal court later today seeking to intervene in the case challenging the constitutionality of the 2004 state ballot measure that defined marriage as the union of one man and one woman. NOM seeks to protect the interests of its members in Oregon which include a County Clerk, professionals in the wedding industry and voters who supported the 2004 amendment to the state constitution. The group said the intervention filing became necessary when the state Attorney General refused to mount a defense of the amendment, a situation that creates a "collusive" lawsuit where the public's interests are unrepresented.

"Marriage in Oregon is worthy of defense, yet the Attorney General has abandoned her duty to defend the marriage state constitutional amendment enacted overwhelmingly in 2004 and in effect has switched sides," said Brian Brown, president of NOM. "As a membership organization, we speak on behalf of our members, including a County Clerk in the state, several professionals in the wedding industry, and voters. All of these individuals have a particularized interest in the outcome of the litigation, yet their interests are not being represented. We are working to protect the interests of our members who support true marriage against a collusive lawsuit that has the state joining with the plaintiffs against the interests of our members, and the state's voters."

The challenge to Measure 36, the state constitutional amendment defining marriage, is currently scheduled for oral argument in federal district court in Eugene on Wednesday, April 23rd.
You know what? I hope they get pushed out of this battle. Haven't they lost enough?
