Supreme Court finds Most of the Arizona's Immigration Law Unconstitutional


The Supreme Court ruled that 3 of the 4 provisions of AZ's SB1070 law was unconstitutional, however they upheld the 'Papers Please' piece of the law.

The parts that were struck down made it a crime for undocumented immigrants seek employment and police to make arrests without a warrant.

While this piece is still there, it faces a lot of lawsuits that can strike it down. This is a good day for the Latino community in Arizona and for our nation. I say good, not great, because the discrimination part of the law still exist.

Hopefully, this will energize the Latino base to continue the fight and end the mess down in Arizona.

New Poll: Latinos are no Fans of the GOP


A new poll shows that Latinos are moving far away from Republican views and very close to the Democrats.

The survey, conducted by a GOP pollster and consultant, found that Latino voters hold "widely negative" views about the Republican party. Envisioned as a way to "begin the process of understanding both the challenges as well as the opportunities for future Republican candidates in gaining a greater share of the Latino vote," the poll found Hispanic voters tend to view GOP candidates as overly conservative and distrust Republican views on immigration.

While California is unlikely to play a defining role in the 2012 elections, the poll could have implications for states like Arizona, Colorado and New Mexico, where Hispanics have increasing political influence.

Commissioned by Republican strategist Marty Wilson, who managed Carly Fiorina's failed campaign for the California Senate, the survey of 400 California Latino voters found a wide Latino-GOP disconnect in the Golden State. Though they tried to frame it in the best terms possible, Wilson and GOP pollster Bob Moore conceded that there was much "work to be done to convince California Latinos that the Republican Party and its candidates can effectively represent them."
I knew that SB1070, and similar bills in other states, would challenge the long standing loyalties of the Latino community and the GOP.  That particular stance sent a strong negative message that will be damaging in future elections.

Gov. Jan Brewer Admits she was Wrong about the Beheadings in Arizona


See, I knew the truth would come out!

Yesterday, I posted a clip of this Sea Hag avoiding the question about beheadings in Arizona's desert.

She claimed that was one of the reasons why she pushed sb1070. Well, she is singing a different tune:
That was an error, if I said that," the Republican told The Associated Press on Friday. "I misspoke, but you know, let me be clear, I am concerned about the border region because it continues to be reported in Mexico that there's a lot of violence going on and we don't want that going into Arizona."

She said she was referring to beheadings and other cartel-related violence in Mexico in comments she made earlier this summer about decapitated bodies found in the state's southern region.

Jan, you are a complete mess.

Judge Blocks a Key Parts of Arizona's SB 1070 law


Judge Susan Bolton just blocked the key pieces of Arizona broke ass immigration law.

NY Times reports:

In a ruling on a law that has rocked politics coast to coast and thrown a spotlight on the border state’s fierce debate over immigration, United States District Court Judge Susan Bolton in Phoenix said some aspects of the law can go into effect as scheduled on Thursday.

But Judge Bolton took aim at the parts of the law that have generated the most controversy, issuing a preliminary injunction against sections that called for officers to check a person’s immigration status while enforcing other laws and that required immigrants to carry their papers at all times.

Judge Bolton put those sections on hold while she continues to hear the larger issues in the challenges to the law.

“Preserving the status quo through a preliminary injunction is less harmful than allowing state laws that are likely preempted by federal law to be enforced,” she said.

“There is a substantial likelihood that officers will wrongfully arrest legal resident aliens,” she wrote. “By enforcing this statute, Arizona would impose a ‘distinct, unusual and extraordinary’ burden on legal resident aliens that only the federal government has the authority to impose.”

The judge’s decision, which came as demonstrators opposed and supporting the law gathered here and after three hearings in the past two weeks in which she peppered lawyers on both sides with skeptical questions, seemed unlikely to quell the debate.

DOJ Challenges Arizona


Here we go. The DOJ is taking Arizona to court over SB107:
The Obama administration sued Arizona on Tuesday to throw out the state's toughest-in-the-nation immigration law and keep other states from copying it.

The lawsuit filed in federal court in Phoenix said the law, due to take effect July 29, usurps the federal government's "pre-eminent authority" under the Constitution to regulate immigration.

The move sets the stage for a high-stakes legal clash over states' rights at a time when politicians in some other states have indicated they want to follow Arizona's lead.

The legal action represents a stern denunciation of the law, which the Justice Department declared will "cause the detention and harassment of authorized visitors, immigrants and citizens who do not have or carry identification documents" while ignoring "humanitarian concerns" and harming diplomatic relations.

There are protest and rallies to come. I wonder how this will turn out.
