Judge Snatches Gov. Walker's Collective Bargaining Law

HuffPo reports:

A Wisconsin judge on Friday struck down the state law championed by Gov. Scott Walker that effectively ended collective bargaining rights for most public workers.
It was not clear if the ruling means the law is immediately suspended. The law took away nearly all collective bargaining rights from most workers and has been in effect for more than a year.
Dane County Circuit Judge Juan Colas ruled that the law violates both the state and U.S. Constitution and is null and void. The ruling comes after a lawsuit brought by the Madison teachers union and a union for Milwaukee city employees.

 Gov. Walker must be mad.

In Wisconsin: County Circuit Judge Strikes Down Anti-Union Bill

Today, the county circuit judge struck down the anti-union law in Wisconsin.

Dane County Circuit Judge Maryann Sumi ruled Thursday that Republican legislators violated Wisconsin's open meetings law during the run up to passage. She says that renders the law void.


The law pushed by Gov. Scott Walker takes away all bargaining rights except over base salary for teachers and other public workers.


The decision is not the end of the legal fight. The state Supreme Court has scheduled arguments for June 6 to determine whether it will take the same case.

So it's not over, but it's giving Scotty a massive headache

Judge Blocks the Anti-Union Law in Wisconsin... For Now

Oh snap! Dane County District Judge Maryann Sumi temporary blocked the collective bargaining law today, making it possible to vote on the bill again.

Dane County District Judge Maryann Sumi granted the order in response to a lawsuit filed by the local Democratic district attorney alleging that Republican lawmakers violated the state's open meetings law by hastily convening a special committee before the Senate passed the bill.


Sumi said her ruling would not prevent the Legislature from reconvening the committee with proper notice and passing the bill again.


Walker spokesman Cullen Werwie would not comment on whether the governor would push to call the Legislature back to pass the bill again, either in its current form or with any changes.

And that's not all, folks...

With the Democrats in Illinois and refusing to return after three weeks away, Republicans convened a special committee last Wednesday to remove the spending items. The bill then passed with no Democrats present.That move is being challenged in another lawsuit brought by Democratic Dane County Executive Kathleen Falk, who argues the bill as passed still should have required the 20-member quorum. The same judge that issued the temporary restraining order was taking testimony Friday in that case, but has said she would not issue a ruling on Friday.
Opponents of the law were hopeful the judge's ruling temporarily blocking enactment of the law would lead to concessions.

"I would hope the Republicans would take this as an opportunity to sit down with Democrats and negotiate a proposal we could all get behind," said Democratic Sen. Jon Erpenbach.

The head of the state's largest teachers union said the Legislature should use this as a chance to listen to opponents of the measure, not vote to pass the same bill again.

"Wisconsin's educators call upon the Legislature to take this as a clear signal that Wisconsinites will not tolerate backroom deals and political power plays when it comes to our public schools and other valued services," said Mary Bell, president of the Wisconsin Education Association Council.

Marty Beil, director of the state's largest public employee union, said in a statement, "We are gratified to see some of our so-called `leaders' finally held accountable for their illegal actions."

Wisconsin Assembly passes Bill that could strip away Union Rights

Those bastards forced this bill through late last night.

MSNBC has the story

The Wisconsin Assembly early Friday passed a bill that would strip most public workers of their collective bargaining rights — the first significant action on the new Republican governor's plan.

The vote put an end to three straight days of punishing debate, but the political standoff over the bill is far from over.

The Assembly vote sends the bill on to the state Senate, where minority Democrats have been missing for a week. No one knows when — or if — they'll return from their hideout in Illinois. Republicans who control the Senate sent state troopers out looking for them at their homes on Thursday, but they turned up nothing.

This mess is far from over. I know today will bring more drama and I will keep you posted.

Labor Unions join the Fight

A super power of labor unions are filing amicus briefs to urge the California Supreme Court to overturn Prop 8. That's big news, because this an predominately non-gay like group coming to our aid.

More than 50 labor unions are a part of this brief. They are: the California Federation of Teachers, SEIU California State Council, the California Labor Federation, the Screen Actors Guild, the California Faculty Association, UNITE HERE! and the California Nurses Association.

In the brief, they state: If a simple majority of voters can take away one fundamental right, it can take away another. If it can deprive one class of citizens of their rights, it can deprive another class too. Today it is gays and lesbians who are singled out. Tomorrow it could be trade unionists."
