VA Attorney General Ken Cuccinelli ends his relationship with King & Spalding

Ken Cuccinelli is being a little bitter. Since King & Spalding dropped the DOMA case, he is dropping them. But why? Here's his reason:

"King & Spalding's willingness to drop a client, the U.S. House of Representatives, in connection with the lawsuit challenging the Defense of Marriage Act (DOMA) was such an obsequious act of weakness that I feel compelled to end your legal association with Virginia so that there is no chance that one of my legal clients will be put in the embarrassing and difficult situation like the client you walked away from, the House of Representatives."

Weakness? Maybe common sense? Maybe since they expressed their support of the LGBT community before all this? Who knows, but I think they will be able to sleep at night knowing Ken no longer needs their services.

Dear Speaker Pelosi:

I am writing to urge you not to proceed with the Senate Patient Protection and Affordable Care Act under a so-called "deem and pass" rule because such a course of action would raise grave constitutional questions.

Based upon media interviews and statements which I have seen, you are considering this approach because it might somehow shield members of Congress from taking a recorded vote on an overwhelmingly unpopular Senate bill.

This is an improper purpose under the bicameralism requirements of Article I, Section 7 of the U.S. Constitution, one of the purposes of which is to make our representatives fully accountable for their votes. Furthermore, to be validly enacted, the Senate bill would have to be accepted by the House in a form that is word-for-word identical (Clinton v. City of New York, 524 U.S. 417 (1998)).

Should you employ the deem and pass tactic, you expose any act which may pass to yet another constitutional challenge. A bill of this magnitude should not be passed using this maneuver. As the President noted last week, the American people are entitled to an up or down vote.

AG Cuccinelli gets owned by Gov. Bob McDonnell

Virginia Gov. Bob McDonnell puts the stop sign on Attorney General Kenneth Cuccinelli's foolishness.

Last week, Cuccinelli wrote this ridic letter about colleges not having the right to include gays in their anti-discrimination policies without General Assembly authorization.

Well, the Governor has stepped in and ended this mess for now:

"It was very important for me... to say discrimination will not be tolerated, and there will be sanctions for anyone that engages in discrimination," McDonnell told reporters Wednesday afternoon.

The governor said the directive was necessary because of the stir caused by Cuccinelli's letter, which led people to fear the loss of "their fundamental rights" or that they'd "be relegated to second-class citizens."

But I'm curious about what made him change his mind. McDonnell has said he not a fan of us, so what really got to him?

AG tells Virginia to Stop Gay Protections

This is very interesting to read.

Virginia Attorney General Ken Cuccienelli II wants VA's public colleges and universities to end all policies that ban discrimination on the basis of sexual orientation, because they have no legal authority to adopt those statements.

In his most aggressive initiative on conservative social issues since taking office in January, Cuccinelli (R) wrote in the letter sent Thursday that only the General Assembly can extend legal protections to gay state employees, students and others -- a move the legislature has repeatedly declined to take as recently as this week.

The letter demonstrates an increasing split in the region's policies on issues related to sexual orientation. It comes in the same week that the District began issuing marriage licenses for gay couples and a week after Maryland's attorney general announced that his state will recognize same-sex marriages performed in other states.

"It is my advice that the law and public policy of the Commonwealth of Virginia prohibit a college or university from including 'sexual orientation,' 'gender identity,' 'gender expression,' or like classification as a protected class within its non-discrimination policy absent specific authorization from the General Assembly," he wrote in the letter.

Really? I'm curious to see how folks are taking this news.
