Trial Judge orders Proposition 8 case closed

District Judge James Ware

This is good!

SDGLN reports:
The trial judge in California’s Proposition 8 lawsuit ordered the case closed today.

This stunning new twist to the case will further complicate matters, since proponents of Proposition 8 have petitioned the U.S. Supreme Court to review the decision of the Ninth Circuit Court of Appeals to uphold the lower court ruling that Proposition 8 was unconstitutional.

The order issued today by District Judge James Ware could mean that gay and lesbian couples in California could once again get married. But even that in uncertain, because Prop 8 proponents are likely to seek a stay of that order.

San Diego Gay & Lesbian News will be updating this story as details emerge. Please continue to refresh this story to find the latest news on the judge's order, plus reactions from the community!

  1. This is interesting. The 9th circuit covers and awful lot of territory with a pretty big population.

And the legal sphere is full of LGBT cases right now. From marriage to DOMA it's all going to head for the USSC at some point.
